2. How we use your information and our lawful basis

We process personal data only where a lawful basis or criterion for lawful processing exists under the DPA. Depending on the activity, we rely on one or more of the following: your consent; the performance of a contract with you (our Terms of Service); compliance with a legal obligation; the protection of vital interests (life, health, and safety); and our legitimate interests (or those of a third party), provided such interests are not overridden by your fundamental rights and freedoms.

3. How we share and disclose information

We share personal data only as described in this Policy. We do not sell your personal data. We may disclose personal data to the following categories of recipients:

4. Location data

Location data is essential to a ride-hailing service. For passengers, we use location to display nearby drivers, calculate fares, navigate trips, and enable trip tracking and the "share my trip" feature. For drivers, precise location is collected while you are online or on an active trip to enable dispatch, navigation, distance calculation, and safety monitoring. You may disable location access through your device settings; however, core features of the Services will not function without it.

5. Cookies and similar technologies

Our websites and apps use cookies, software development kits (SDKs), and similar technologies for authentication, security, preference storage, performance measurement, and analytics. You can manage cookies through your browser or device settings, although some features may not work properly if you disable them.

6. Data retention and deletion

We retain personal data only for as long as your account is active or as necessary to fulfil the purposes described in this Policy, after which we securely dispose of it. We may retain certain records for longer where required to comply with legal, tax, accounting, regulatory, dispute-resolution, fraud-prevention, or safety obligations. Where records must be retained for such purposes, we may keep them in anonymized or de-identified form so that they can no longer be associated with you.

You may request deletion of your account at any time. See our Account Deletion page, or use the in-app delete-account option, which anonymizes your personal data, revokes your access tokens, and disables your account.

7. Your rights as a data subject

Under the Data Privacy Act of 2012, you are entitled to the following rights with respect to your personal data:

To exercise any of these rights, email orbitsdev00@gmail.com. We may need to verify your identity before acting on your request, and we will respond within the period prescribed by applicable law. Exercising certain rights (such as erasure) may limit or prevent your continued use of the Services.

8. Data security

We implement reasonable and appropriate organizational, physical, and technical security measures intended to protect personal data against accidental or unlawful destruction, alteration, disclosure, and unauthorized access, consistent with the DPA.

While we work continuously to protect your information, no method of transmission or storage is completely secure. In the event of a personal data breach that meets the notification threshold, we will notify the National Privacy Commission and affected data subjects in accordance with applicable law.

9. International and third-party transfers

Some of our service providers and infrastructure may be located outside the Philippines. Where personal data is transferred to or accessed from another jurisdiction, we remain accountable for that data and take steps to ensure it is afforded a comparable level of protection through appropriate contractual and organizational safeguards, consistent with the DPA.

10. Children

The Services are intended for individuals who are at least 18 years of age. We do not knowingly collect personal data from minors. If we learn that we have collected personal data from a person under 18 without appropriate authority, we will take steps to delete it.

11. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. We will revise the "Last updated" date above and, where the changes are material, provide a more prominent notice in the app or by other appropriate means.
